Are you concerned about how you were reassigned?

Here are some things to keep in mind:

CBC management has the right to make, and change, your assignment and to set your shift. The Guild expects this to be done in a reasonable manner.

You do have rights in the process and your reassignment, including shift assignment, cannot be used as a form of disguised discipline. Your reassignment should take into account your skills and experience. As well:

– your base salary cannot be reduced as a result of reassignment (additional remuneration can be affected);
– you cannot be assigned to a job in a lower classification on a continuous basis;
– if you are assigned to do the principal functions of a higher pay band, you should be paid according to that band;
– you are not required to accept a promotion to a job in a higher pay band;
– you should be scheduled with at least 12 hours off between shifts and you get an additional 15% pay for any hour worked between midnight and 7 am;
– you cannot be discriminated against on the basis of sex, colour, age, disability, religion, creed, race, ethnic or national origin, marital or parental status, sexual orientation, political affiliation, membership or activity in the union, or conviction for an offence for which a pardon has been granted.

According to our collective agreement, there is no requirement for CBC management to post assignments, although they choose to do so from time to time, something the Guild encourages. Management is required to post a position when it is vacant and needs to be filled.

There are additional provisions in the collective agreement for producers, who cannot be removed from a program and whose assignment cannot be changed without justification and without a discussion with the affected employee. Further, “senior” and “executive” producer designations cannot be changed “in a capricious manner.” Producers can request reasons for a change in assignment in writing.
