The Corporation has recently been approaching various employees concerning negotiation or re-negotiation of additional compensation and overtime buyouts. These types of payments are anticipated under the terms of the CMG/CBC Collective Agreement.
Employees who are involved in these types of negotiations are entitled to assistance from Guild Staff Representatives. Such help could include everything from research up to and including actual representation at the negotiating table.
A couple of key points to note:
– Overtime buyouts cannot be imposed; they must be agreed to by both the employee and the employer. They are supposed to be designed to accurately predict the level of overtime anticipated over a specific time (e.g. one year). When negotiating a buyout, actual time worked should be calculated to assess the value of the buyout, including work on days off. (See Article 60.7)
– Additional Remuneration can be paid as the result of recognition of an employee’s contribution to the Corporation (see Article 53.6). It can also be provided in the context of a “workload agreement” for self-assigned employees. (see Article 58.5.3)
