{"id":17896,"date":"2007-05-18T00:00:00","date_gmt":"2007-05-18T00:00:00","guid":{"rendered":"http:\/\/cmg.ca\/fr\/2007\/05\/18\/un-proprietaire-de-toronto-refuse-de-louer-a-un-syndicat-des-medias-2\/"},"modified":"2023-06-03T15:37:32","modified_gmt":"2023-06-03T19:37:32","slug":"un-proprietaire-de-toronto-refuse-de-louer-a-un-syndicat-des-medias-2","status":"publish","type":"post","link":"https:\/\/cmg.ca\/fr\/nouvelles\/un-proprietaire-de-toronto-refuse-de-louer-a-un-syndicat-des-medias-2\/","title":{"rendered":"Un propri\u00e9taire de Toronto refuse de louer \u00e0 un syndicat des m\u00e9dias"},"content":{"rendered":"<p>Un propri\u00e9taire immobilier de Toronto a refus\u00e9 de louer un local \u00e0 la Guilde canadienne des m\u00e9dias \u00e0 cause des pressions antisyndicales exerc\u00e9es par le radiodiffuseur sportif The Score, d\u00e9j\u00e0 locataire dans l\u2019\u00e9difice.    <\/p>\n<p>\u00ab On est en droit de se demander pourquoi The Score a peur de nous \u00bb, a sugg\u00e9r\u00e9 Lise Lareau, pr\u00e9sidente de la GCM.   <\/p>\n<p>Le Westmont Hospitality Group (\u00e9galement connu sous le nom de King Street Enterprises), qui abrite un Holiday Inn de m\u00eame que The Score et d\u2019autres locataires commerciaux au 370, rue King ouest, a annonc\u00e9 au d\u00e9but mai \u00e0 la Guilde que rien n\u2019allait plus.   <\/p>\n<p>Le bail avait pourtant \u00e9t\u00e9 sign\u00e9 et presque remis \u00e0 la GCM \u2013 qui repr\u00e9sente des employ\u00e9s de la SRC\/CBC, de la Presse canadienne, de TVO et d\u2019autres m\u00e9dias \u2014 lorsque le propri\u00e9taire s\u2019est rendu compte que son futur locataire \u00e9tait un syndicat et a tent\u00e9 de lui faire promettre de ne jamais tenter de syndicaliser les employ\u00e9s du radiodiffuseur The Score.   <\/p>\n<p>Mme Lareau et le vice-pr\u00e9sident de la GCM, Scott Edmonds, ont rencontr\u00e9 le propri\u00e9taire pour lui expliquer qu\u2019un syndicat ne signerait jamais une telle entente; ce sont les travailleurs qui choisissent leur syndicat. Ils ont toutefois pr\u00e9cis\u00e9 que la pr\u00e9sence de The Score dans l\u2019\u00e9difice n\u2019avait rien \u00e0 voir avec leur intention d\u2019emm\u00e9nager dans l\u2019\u00e9difice.   <\/p>\n<p>Ils ont m\u00eame offert d\u2019essayer de faire comprendre au radiodiffuseur que des employ\u00e9s du syndicat ne patrouilleraient pas devant leur porte dans l\u2019espoir de saisir une proie.     <\/p>\n<p>Mais le propri\u00e9taire et The Score semblent avoir d\u00e9cid\u00e9 qu\u2019ils ne peuvent pas prendre le risque d\u2019exposer les employ\u00e9s aux dangers d\u2019une appartenance syndicale, et ont laiss\u00e9 savoir au syndicat que la GCM n\u2019\u00e9tait pas bienvenue dans l\u2019\u00e9difice.  <\/p>\n<p>Mme Lareau a l\u2019intention de s\u2019assurer que les employ\u00e9s du radiodiffuseur r\u00e9alisent bien que leurs patrons ont eu recours \u00e0 une transaction immobili\u00e8re pour exclure un syndicat de l\u2019\u00e9difice, et ajoute qu\u2019elle songe \u00e0 intenter une poursuite afin d\u2019obtenir compensation pour les trois mois consacr\u00e9s \u00e0 la n\u00e9gociation du bail avant que la question syndicale fasse surface.    <\/p>\n<p>\u00ab Cette d\u00e9cision soul\u00e8ve de s\u00e9rieuses pr\u00e9occupations pour tous les syndicats et tous les travailleurs.  Ce propri\u00e9taire a jug\u00e9 acceptable d\u2019enfreindre les droits constitutionnels de la libre association, ou les garanties contenues dans le Code du travail du Canada relativement au droit des gens de se syndiquer\u2026 afin d\u2019apaiser les craintes d\u2019un autre locataire \u00bb, a d\u00e9clar\u00e9 Mme Lareau.   <\/p>\n<p>\u00ab Nous avons ici un autre exemple d\u2019une entreprise qui \u00e9rode les droits des travailleurs et des syndicats \u2013 sans devoir en subir aucune cons\u00e9quence \u00bb, a ajout\u00e9 Ken Georgetti, pr\u00e9sident du Congr\u00e8s du travail du Canada.  <\/p>\n<p>Le propri\u00e9taire immobilier soutien maintenant que sa d\u00e9cision rel\u00e8ve simplement du fait qu\u2019un autre locataire d\u00e9sire occuper une plus grande superficie dans l\u2019immeuble, mais c\u2019est l\u00e0 quelque chose de nouveau.  Selon Mme Lareau, il a \u00e9t\u00e9 dit de fa\u00e7on tr\u00e8s claire le 5 avril que le seul obstacle \u00e0 la ratification d\u2019un bail final \u00e9tait que la GCM est un syndicat.     <\/p>\n<p>\u00ab \u00c0 la mi-avril, ils \u00e9taient toujours tr\u00e8s int\u00e9ress\u00e9s \u00e0 nous avoir comme locataire, et ils auraient finalis\u00e9 le bail avant la venue de tout autre locataire \u00e0 la seule condition que nous promettions de ne pas nous comporter comme un syndicat \u00bb, a pr\u00e9cis\u00e9 M. Edmonds. <\/p>\n<p>\u00ab Je n\u2019ai jamais vu une telle question soulev\u00e9e dans une transaction immobili\u00e8re \u00bb, a comment\u00e9 Edward Glavan, de LNR Corporation, le courtier de la Guilde.  \u00ab Il s\u2019agit l\u00e0 d\u2019une utilisation malveillante du processus immobilier que nous connaissons. \u00bb    <\/p>\n<p>La GCM cherchait \u00e0 louer un espace de 5 000 pieds carr\u00e9s au cinqui\u00e8me \u00e9tage.  Quelques heures avant la ratification d\u00e9finitive du bail, le propri\u00e9taire a demand\u00e9 \u00e0 la Guilde de signer une renonciation \u00e0 l\u2019effet qu\u2019elle ne tenterait pas de syndiquer The Score.
