Ces ententes se veulent l&rsquo;aboutissement de discussions franches et productives entre le syndicat et la direction. Chaque enjeu au coeur de ces discussions fut r\u00e9gl\u00e9 \u00e0 la satisfaction du ou des membres touch\u00e9s.<\/p>\n<p>\u00ab\u00a0De notre point de vue, la proc\u00e9dure de r\u00e8glement des diff\u00e9rends \u00e9volue de fa\u00e7on satisfaisante, a indiqu\u00e9 Elaine James, pr\u00e9sidente du comit\u00e9 national des griefs de la Guilde. Le nombre de conflits qui se retrouvent en arbitrage est significativement inf\u00e9rieur \u00e0 ce qu&rsquo;il \u00e9tait il y a deux ans. On constate aussi moins de situations conflictuelles qui nous proviennent des unit\u00e9s locales. J&rsquo;ose esp\u00e9rer que cela signifie que les probl\u00e8mes sont r\u00e9gl\u00e9s sur place.\u00a0\u00bb<\/p>\n<p>En ce qui a trait au processus disciplinaire, il s&rsquo;agit d&rsquo;un cas o\u00f9 un employ\u00e9 a \u00e9t\u00e9 invit\u00e9 \u00e0 avoir une conversation avec son sup\u00e9rieur sans \u00eatre repr\u00e9sent\u00e9 par le syndicat. Cet employ\u00e9 a subs\u00e9quemment fait l&rsquo;objet d&rsquo;une suspension, en partie suite \u00e0 ladite conversation. Si jamais on vous demande de prendre part \u00e0 une conversation qui, selon vous, pourrait porter sur des mesures disciplinaires, assurez-vous de demander la pr\u00e9sence d&rsquo;un repr\u00e9sentant de la Guilde. Si vous vous trouvez d&rsquo;ores et d\u00e9j\u00e0 au coeur d&rsquo;une conversation qui vous semble mener vers une mesure disciplinaire, mettez-y un terme et communiquez avec un repr\u00e9sentant de la Guilde de votre bureau local. <\/p>\n<p>Certains griefs qui demeurent \u00e0 ce jour non r\u00e9solus portent notamment sur la promotion. La Guilde est d&rsquo;avis que, dans tous les cas, les crit\u00e8res subjectifs l&#8217;emportent sur les crit\u00e8res objectifs (notamment les comp\u00e9tences et l&rsquo;anciennet\u00e9) lors des d\u00e9cisions relatives aux promotions. Lorsque la Soci\u00e9t\u00e9 est appel\u00e9e \u00e0 faire un choix parmi deux candidats \u00e0 l&rsquo;interne aux comp\u00e9tences relativement \u00e9gales, la direction doit favoriser le candidat ayant le plus d&rsquo;anciennet\u00e9. <\/p>\n<p>Nous poursuivons aussi nos discussions avec la Soci\u00e9t\u00e9 en ce qui a trait \u00e0 leur recours \u00e0 des stagiaires. Ici, les conditions sp\u00e9cifi\u00e9es dans la convention collective ne sont pas respect\u00e9es de fa\u00e7on syst\u00e9matique. La Guilde est en attente de pr\u00e9cisions de la part de la direction, \u00e0 savoir quelle est la nature du travail effectu\u00e9 par chaque stagiaire, et dans quel d\u00e9partement. Rappelez-vous que les stagiaires ne devraient pas \u00eatre r\u00e9mun\u00e9r\u00e9s, \u00e0 moins de faire partie d&rsquo;un programme reconnu \u00e9tabli par la Soci\u00e9t\u00e9 apr\u00e8s consultation aupr\u00e8s de la Guilde. La Soci\u00e9t\u00e9 ne peut avoir recours \u00e0 des stagiaires pour remplacer le personnel ou pour contourner la n\u00e9cessit\u00e9 de combler un poste ou d&#8217;embaucher un employ\u00e9 temporaire. Pour de plus amples renseignements, veuillez vous r\u00e9f\u00e9rer \u00e0 l\u2019Article 32 de la convention collective. <\/p>\n<p>N&rsquo;oubliez pas : la meilleure approche pour r\u00e9gler rapidement un diff\u00e9rend en milieu de travail est d&rsquo;avoir recours \u00e0 la disposition de la convention collective portant sur la r\u00e9solution de diff\u00e9rends (l\u2019Article\u00a016). La premi\u00e8re \u00e9tape consiste \u00e0 en discuter avec votre superviseur.
