{"id":18903,"date":"2007-10-15T00:00:00","date_gmt":"2007-10-15T00:00:00","guid":{"rendered":"http:\/\/cmg.ca\/fr\/2007\/10\/15\/la-cour-supreme-confirme-la-reintegration-dun-employe-2\/"},"modified":"2023-06-03T15:37:12","modified_gmt":"2023-06-03T19:37:12","slug":"la-cour-supreme-confirme-la-reintegration-dun-employe-2","status":"publish","type":"post","link":"https:\/\/cmg.ca\/fr\/nouvelles\/la-cour-supreme-confirme-la-reintegration-dun-employe-2\/","title":{"rendered":"La Cour supr\u00eame confirme la r\u00e9int\u00e9gration d\u2019un employ\u00e9"},"content":{"rendered":"<p><b>La Cour supr\u00eame confirme la r\u00e9int\u00e9gration d\u2019un employ\u00e9<\/b><br \/>\nLa Cour supr\u00eame du Canada a refus\u00e9 la requ\u00eate de la CBC\/Radio-Canada qui voulait en appeler d\u2019une d\u00e9cision datant de 2004 d\u2019un arbitre qui r\u00e9int\u00e8gre un employ\u00e9 renvoy\u00e9. La cour exige que la Soci\u00e9t\u00e9 d\u00e9fraie les co\u00fbts l\u00e9gaux de la GCM. <\/p>\n<p>\u00ab\u00a0Malheureusement, la Soci\u00e9t\u00e9 semble croire que ceux qui prennent une position contraire \u00e0 la sienne sont constamment dans l\u2019erreur. Cette attitude s\u2019applique \u00e9galement aux d\u00e9cisions des arbitres et des tribunaux, affirme Dan Oldfield, premier n\u00e9gociateur \u00e0 la Guilde canadienne des m\u00e9dias. \u00ab\u00a0M\u00eame \u00e0 la suite d\u2019une d\u00e9cision unanime de la Cour d\u2019appel de la Colombie-Britannique qui confirmait que la d\u00e9cision de l\u2019arbitre \u00e9tait raisonnable et relevait de sa juridiction, la Soci\u00e9t\u00e9 a d\u00e9cid\u00e9 de tenter d\u2019en appeler \u00e0 la Cour supr\u00eame et ainsi encourir des dizaines de milliers de dollars en frais l\u00e9gaux.\u00a0\u00bb<\/p>\n<p>L\u2019employ\u00e9 en question a \u00e9t\u00e9 d\u00e9mis de ses fonctions \u00e0 la suite d\u2019une erreur de jugement. Il a imm\u00e9diatement reconnu son erreur et il s\u2019est excus\u00e9. Il a, de plus, pris des mesures pour r\u00e9parer la situation. Selon le syndicat, l\u2019employ\u00e9 aurait m\u00e9rit\u00e9 une suspension mais pas un renvoi. La Guilde a propos\u00e9 de r\u00e9gler le diff\u00e9rend avant de se retrouver devant un arbitre. La direction a refus\u00e9 et elle a d\u00e9pens\u00e9 des centaines de milliers de dollars pour continuer sur la voie juridique.<\/p>\n<p>La d\u00e9cision originelle de l\u2019arbitre est maintenu et l\u2019employ\u00e9 va recevoir son salaire r\u00e9troactif \u00e0 2003 et son emploi lui sera rendu.<\/p>\n<p>\u00ab\u00a0Nous sommes heureux que cette histoire est maintenant chose du pass\u00e9, ajoute M. Oldfield. \u00ab\u00a0Ce n\u2019est pas seulement une bonne nouvelle pour un de nos membres mais c\u2019est aussi une bonne nouvelle pour le syst\u00e8me canadien d\u2019arbitrage. Cette d\u00e9cision confirme \u00e0 nouveau la cr\u00e9dibilit\u00e9 que d\u00e9tient une tierce partie qui fait preuve de neutralit\u00e9 lorsque vient le temps de r\u00e9gler un diff\u00e9rend entre un employeur et un syndicat.\u00a0\u00bb <\/p>\n<p><b>Le cong\u00e9 non pay\u00e9 \u00ab\u00a0accord\u00e9 automatiquement\u00a0\u00bb s\u2019il ne fait pas obstacle<\/b><br \/>\nTel que rapport\u00e9 au mois de juillet, un arbitre a clarifi\u00e9 que la Soci\u00e9t\u00e9 doit essayer de r\u00e9pondre au besoin de ses employ\u00e9s qui veulent un cong\u00e9 sans solde pour des raisons personnelles ou professionnelles. Si le cong\u00e9 n\u2019emp\u00eache pas l\u2019exploitation normale de l\u2019entreprise, le cong\u00e9 doit \u00eatre accord\u00e9 \u00ab\u00a0presque automatiquement.\u00a0\u00bb <\/p>\n<p>L\u2019arbitre Stephen Raymond a accord\u00e9 un cong\u00e9 non pay\u00e9 \u00e0 un employ\u00e9 qui avait subi un refus de la part de la direction. Il a \u00e9crit qu\u2019afin de justifier son refus, la Soci\u00e9t\u00e9 doit d\u00e9montrer que \u00ab\u00a0nous avons besoin de faire ceci et qu\u2019en son absence nous serons dans l\u2019impossibilit\u00e9 de le faire\u00a0\u00bb. S\u2019il n\u2019y a pas d\u2019entrave \u00e0 l\u2019exploitation de l\u2019entreprise, le cong\u00e9 de l\u2019employ\u00e9 n\u2019a pas besoin de profiter \u00e0 CBC\/Radio-Canada.<\/p>\n<p>Si on vous a refus\u00e9 une demande de cong\u00e9 non pay\u00e9, contactez un repr\u00e9sentant local de la Guilde ou appelez le Bureau national au 416 591-5333 ou sans frais au 1-800-465-4149. Vous pouvez aussi \u00e9crire un courriel au info@cmg.ca.<\/p>\n<p><b>R\u00e8glement pour un employ\u00e9 qui s\u2019est fait refuser un cong\u00e9 de d\u00e9c\u00e8s additionnel<\/b><br \/>\nUn employ\u00e9, qui avait \u00e9t\u00e9 forc\u00e9 de prendre des cong\u00e9s annuels pour aider sa m\u00e8re \u00e2g\u00e9e \u00e0 organiser les fun\u00e9railles de son p\u00e8re \u00e0 l\u2019ext\u00e9rieur de la ville, s\u2019est entendu avec la CBC pour recevoir deux jours de cong\u00e9 pay\u00e9s additionnels.<\/p>\n<p>Un employ\u00e9 a droit imm\u00e9diatement apr\u00e8s le d\u00e9c\u00e8s d\u2019un parent \u00e0 trois jours de cong\u00e9 cons\u00e9cutifs. La convention collective stipule que \u00ab\u00a0du temps pour voyager, en plus des 3 jours, peut \u00eatre allou\u00e9 selon des circonstances particuli\u00e8res. Ce temps de voyage ne sera pas refus\u00e9 ind\u00fbment.\u00a0\u00bb De plus, un employ\u00e9 peut avoir un cong\u00e9 sp\u00e9cial pour s\u2019occuper d\u2019une urgence familiale.<\/p>\n<p>Le diff\u00e9rend a \u00e9t\u00e9 r\u00e9gl\u00e9 seulement lorsque le syndicat a voulu choisir un arbitre pour entendre la cause, soit un an apr\u00e8s la demande de cong\u00e9 additionnel de l\u2019employ\u00e9 en question. <\/p>\n<p><b>Des douzaines de griefs pr\u00e9vus pour l\u2019arbitrage<\/b><br \/>\nLa Guilde est d\u00e9\u00e7ue d\u2019annoncer qu\u2019un tr\u00e8s grand nombre de griefs seront soumis \u00e0 l\u2019arbitrage malgr\u00e9 l\u2019espoir que la nouvelle proc\u00e9dure avait soulev\u00e9 car elle devait permettre de r\u00e9gler plus rapidement les diff\u00e9rends. <\/p>\n<p>La Guilde constate que les superviseurs locaux dans plusieurs milieux de travail ne cherchent pas \u00e0 r\u00e9gler les situations conflictuelles et les refilent plut\u00f4t au bureau national des Relations industrielles.<\/p>\n<p>\u00ab\u00a0La Guilde aimerait voir les diff\u00e9rends se r\u00e9gler au moment et \u00e0 l\u2019endroit o\u00f9 ils se produisent, a d\u00e9clar\u00e9 le pr\u00e9sident de la sous-section, Marc-Philippe Laurin. \u00ab\u00a0La convention collective ouvre la porte \u00e0 des solutions cr\u00e9atives. Il faudrait laisser les gens au niveau local n\u00e9gocier car ils sont directement concern\u00e9s par la situation. L\u2019arbitrage est suppos\u00e9 \u00eatre un dernier recours. Malheureusement, l\u2019arbitrage est devenu la norme \u00e0 Radio-Canada. Cette situation entra\u00eene un gaspillage de temps et d\u2019argent pour les deux parties.\u00a0\u00bb<\/p>\n<p>\u00ab\u00a0Il semble que la direction prend les disputes au s\u00e9rieux seulement lorsqu\u2019elles sont sur le point d\u2019\u00eatre entendues par un arbitre\u00a0\u00bb, dit M. Laurin. \u00ab\u00a0Malgr\u00e9 nos efforts pour faire entendre ces causes le plus rapidement possible, la direction nous met des b\u00e2tons dans les roues. \u00c7a veut dire des mois, parfois m\u00eame des ann\u00e9es, de frustration pour les employ\u00e9s en question.\u00a0\u00bb <\/p>\n<p>Il y a 98 griefs qui ne sont toujours pas r\u00e9gl\u00e9s et qui ont \u00e9t\u00e9 d\u00e9pos\u00e9s en violation de la plus r\u00e9cente convention collective. Ils portent, entre autres, sur des questions de renvoi injustifi\u00e9, de r\u00e9trogradation et de temps suppl\u00e9mentaire impay\u00e9. De ce nombre, 70 ont \u00e9t\u00e9 soumis \u00e0 un arbitre, incluant 21 cas o\u00f9 la direction de CBC\/Radio-Canada et la Guilde ne s\u2019entendent pas \u00e0 la suite du processus d\u2019\u00e9valuation des emplois. De plus, il reste encore 35 griefs non r\u00e9gl\u00e9s qui datent de la convention collective pr\u00e9c\u00e9dente. <\/p>\n<p><b>La GCM continue sa lutte contre le recours abusif aux employ\u00e9s temporaires et contractuels<\/b><br \/>\nUn bon nombre de cas ont \u00e9t\u00e9 soumis \u00e0 l\u2019arbitrage car le syndicat croit que la direction de CBC\/Radio-Canada refuse d\u2019accorder une permanence \u00e0 des employ\u00e9s.<br \/>\nLe grief d\u00e9pos\u00e9 l\u2019hiver dernier portant sur le recours syst\u00e9matique et abusif d\u2019embauches temporaires doit \u00eatre entendu en f\u00e9vrier prochain par un arbitre. Entre-temps, la Guilde est ouverte \u00e0 rencontrer la direction afin de r\u00e9gler ce diff\u00e9rend.<\/p>\n<p>De plus, des griefs individuels ont \u00e9t\u00e9 d\u00e9pos\u00e9s lorsque des employ\u00e9s non permanents ont \u00e9t\u00e9 renvoy\u00e9s ou lorsqu\u2019ils se sont vus refuser des postes permanents l\u00e0 o\u00f9 il y avait du travail sur une base continuelle.<\/p>\n<p>Une autre plainte porte sur le fait que la Soci\u00e9t\u00e9 a rempli presque tous les nouveaux postes continuels par des employ\u00e9s \u00e0 contrat malgr\u00e9 les intentions exprim\u00e9es par la direction lors des n\u00e9gociations de 2005. \u00c0 l\u2019\u00e9poque, la direction avait d\u00e9clar\u00e9 au pays entier dans les pages des journaux qu\u2019elle avait besoin de souplesse pour embaucher des gens qui travailleraient \u00e0 contrat aux nouvelles \u00e9missions afin de pouvoir changer rapidement de \u00ab\u00a0formats et de structures\u00a0\u00bb.<\/p>\n<p>Dans les faits, des employ\u00e9s travaillent pr\u00e9sentement \u00e0 contrat dans presque toutes les cat\u00e9gories d\u2019emplois comme l\u2019entretien, l\u2019administration et comme reporters aux nouvelles locales. Ces emplois ne faisaient m\u00eame pas partie du projet initial de la direction.<\/p>\n<p>CBC\/Radio-Canada est maintenant sur le point d\u2019atteindre le nombre maximum d\u2019employ\u00e9s \u00e0 contrat tel que pr\u00e9vu par la convention collective. Le contrat de travail permet \u00e0 la Soci\u00e9t\u00e9 d\u2019embaucher sur une base contractuelle un nombre \u00e9quivalent \u00e0 9,5% des employ\u00e9s permanents, plus 80 postes. En date du 2 septembre, la Soci\u00e9t\u00e9 a affirm\u00e9 \u00e0 la Guilde que le nombre d\u2019employ\u00e9s \u00e0 contrat se situait \u00e0 9,4% de la main-d\u2019\u0153uvre permanente. Cependant, les calculs de la Guilde donne un r\u00e9sultat un peu plus \u00e9lev\u00e9, soit 9,5% plus 16 postes.<\/p>\n<p>De plus, la direction de la Soci\u00e9t\u00e9 a pris la position que les postes affich\u00e9s \u00ab\u00a0\u00e0 contrat\u00a0\u00bb ne sont pas disponibles aux employ\u00e9s qui font face \u00e0 une mise \u00e0 pied.
