Les employ\u00e9s concern\u00e9s travaillent \u00e0 une \u00e9mission o\u00f9 ils sont soumis \u00e0 des \u00e9ch\u00e9anciers quotidiens. On leur a indiqu\u00e9 qu\u2019ils \u00e9taient des employ\u00e9s \u00e0 r\u00e9gime libre ou \u00e0 horaire libre hebdomadaire, et qu\u2019on ne s\u2019attendait pas \u00e0 ce qu\u2019ils r\u00e9clament des heures suppl\u00e9mentaires. <\/p>\n<p>Un r\u00e8glement a \u00e9t\u00e9 conclu dans l\u2019un de ces cas. La Guilde tente aussi de r\u00e9gler des probl\u00e8mes r\u00e9pandus concernant les horaires de travail au service du Divertissement factuel de la CBC-TV. Un grief regroupant plusieurs employ\u00e9s est en voie d\u2019\u00eatre soumis \u00e0 l\u2019arbitrage.   <\/p>\n<p>N\u2019oubliez pas qu\u2019\u00e0 titre d\u2019employ\u00e9 \u00e0 horaire libre, vous contr\u00f4lez votre horaire de travail en autant que le travail est fait. Vous n\u2019avez pas d\u2019horaire fixe et vous n\u2019avez pas \u00e0 demander la permission \u00e0 quiconque pour vous absenter du travail. Si vous \u00eates un employ\u00e9 inscrit \u00e0 l\u2019horaire journalier ou \u00e0 l\u2019horaire hebdomadaire, vos heures ou vos jours de travail sont fixes et vous devriez r\u00e9clamer des heures suppl\u00e9mentaires si vous travaillez davantage. Si vous \u00eates soumis \u00e0 un \u00e9ch\u00e9ancier quotidien, vous devriez \u00eatre inscrit \u00e0 l\u2019horaire journalier et r\u00e9clamer des heures suppl\u00e9mentaires pour le travail effectu\u00e9 apr\u00e8s les heures pr\u00e9vues. (Voir article 58 de la convention collective pour plus d\u2019information sur les employ\u00e9s inscrits \u00e0 horaire journalier, \u00e0 horaire hebdomadaire ou \u00e0 horaire libre.) <\/p>\n<p><b>R\u00e8glement pour un employ\u00e9 temporaire cong\u00e9di\u00e9 avant 18 mois<\/b><br \/>\nUn r\u00e8glement de derni\u00e8re minute a \u00e9t\u00e9 conclu pour un employ\u00e9 temporaire qui avait \u00e9t\u00e9 cong\u00e9di\u00e9 par la SRC\/CBC en janvier dernier, quelques semaines seulement avant d\u2019avoir le droit d\u2019obtenir la permanence. Le syndicat a log\u00e9 un grief, faisant valoir que la direction de la SRC\/CBC avait cong\u00e9di\u00e9 l\u2019employ\u00e9 pour \u00e9viter de lui accorder un emploi permanent. Le r\u00e8glement est survenu avant que la cause ne soit entendue en arbitrage. <\/p>\n<p>Le grief de la Guilde concernant l\u2019abus syst\u00e9matique de l\u2019embauche temporaire \u00e0 la SRC\/CBC a \u00e9t\u00e9 r\u00e9f\u00e9r\u00e9 \u00e0 l\u2019arbitrage.  <\/p>\n<p><b>Promotion refus\u00e9e \u00e0 une employ\u00e9e ayant le plus d\u2019anciennet\u00e9 et les meilleures qualifications<\/b><br \/>\nUne employ\u00e9e s\u2019est vu refuser une promotion \u00e0 un poste permanent apr\u00e8s y avoir avait fourni un rendement satisfaisant \u00e0 titre d\u2019employ\u00e9e temporaire. Le poste a \u00e9t\u00e9 attribu\u00e9 \u00e0 un coll\u00e8gue ayant moins d\u2019anciennet\u00e9. La Guilde estime que l\u2019employ\u00e9e ayant plus d\u2019anciennet\u00e9 \u00e9tait la mieux qualifi\u00e9e et aurait d\u00fb obtenir la promotion. Le syndicat a r\u00e9f\u00e9r\u00e9 la cause \u00e0 l\u2019arbitrage.<\/p>\n<p><b>La direction de la SRC\/CBC refuse d\u2019accomoder les besoins d\u2019une employ\u00e9e handicap\u00e9e<\/b><br \/>\nLa direction de la SRC\/CBC refuse de reconna\u00eetre et de tenir compte des difficult\u00e9s d\u2019apprentissage d\u2019une employ\u00e9e, apr\u00e8s avoir menac\u00e9 de la cong\u00e9dier en vertu des dispositions de son Plan d\u2019am\u00e9lioration de la convention collective. L\u2019employ\u00e9e de 17 ans avait r\u00e9cemment \u00e9t\u00e9 \u00e9valu\u00e9e par des professionnels d\u2019envergure nationale en difficult\u00e9s d\u2019apprentissage sans que  la SRC\/CBC n\u2019admette les r\u00e9sultats. La direction lui avait donn\u00e9 le choix d\u2019accepter un emploi subalterne ou d\u2019\u00eatre cong\u00e9di\u00e9e. Aucun effort n\u2019a \u00e9t\u00e9 fait pour r\u00e9pondre \u00e0 ses difficult\u00e9s d\u2019apprentissage lorsqu\u2019elle a \u00e9t\u00e9 embauch\u00e9e. La Guilde a r\u00e9f\u00e9r\u00e9 la cause en arbitrage. <\/p>\n<p><b>La CBC refuse un cong\u00e9 additionnel pour cause de d\u00e9c\u00e8s.<\/b><br \/>\nUn arbitre devra d\u00e9cider si la direction de la SRC\/CBC a agi de fa\u00e7on d\u00e9raisonnable en refusant un cong\u00e9 de d\u00e9c\u00e8s additionnel de deux jours \u00e0 une employ\u00e9e dont le p\u00e8re est d\u00e9c\u00e9d\u00e9. La famille de l\u2019employ\u00e9e habitait en dehors de la r\u00e9gion et celle-ci a d\u00fb voyager, s\u2019occuper de sa m\u00e8re \u00e2g\u00e9e et des arrangements fun\u00e9raires, en plus de pr\u00e9voir l\u2019enterrement dans une autre ville. Notre entente collective stipule que la direction de la SRC\/CBC peut accorder plus de temps lors de circonstances sp\u00e9ciales.  <\/p>\n<p>Plusieurs employ\u00e9s de la SRC\/CBC, et notamment des gestionnaires, ont assist\u00e9 aux fun\u00e9railles. Les coll\u00e8gues de travail de l\u2019employ\u00e9e en deuil ont d\u00fb utiliser leur cong\u00e9 annuel pay\u00e9 pour assister aux fun\u00e9railles.  <\/p>\n<p><b>R\u00e8glement \u00e0 la suite d\u2019un refus de cong\u00e9 sp\u00e9cial<\/b><br \/>\nUn r\u00e8glement a \u00e9t\u00e9 conclu entre un employ\u00e9 qui s\u2019\u00e9tait vu refuser un cong\u00e9 sp\u00e9cial et la Soci\u00e9t\u00e9. Cependant, le syndicat continue de s\u2019inqui\u00e9ter du fait que les dispositions de cong\u00e9 sp\u00e9cial ne sont pas appliqu\u00e9es de fa\u00e7on raisonnable. Chaque demande devrait \u00eatre \u00e9valu\u00e9e individuellement et le cong\u00e9 sp\u00e9cial accord\u00e9 selon le m\u00e9rite de la demande.  <\/p>\n<p><b>Y a-t-il un m\u00e9decin dans la salle?<\/b><br \/>\nLa SRC\/CBC a refus\u00e9 d\u2019accepter une note d\u2019un chiropraticien, justifiant l\u2019absence d\u2019un employ\u00e9 pour raisons m\u00e9dicales. La direction de la SRC\/CBC fait valoir qu\u2019un chiropraticien n\u2019est pas un m\u00e9decin, malgr\u00e9 le fait que les chiropraticiens d\u00e9tiennent un permis et sont reconnus comme tel dans le r\u00e9gime des prestations d\u2019assurance sant\u00e9 de la SRC\/CBC. La position ridicule de la direction de la SRC\/CBC contraint les employ\u00e9s \u00e0 consulter un deuxi\u00e8me praticien (c\u2019est-\u00e0-dire un m\u00e9decin) seulement pour obtenir le billet du m\u00e9decin.
