Le conciliateur devrait \u00eatre nomm\u00e9 au cours des deux prochaines semaines.<\/p>\n<p><strong>Et puis\u2026?<\/strong><\/p>\n<p>Le mandat du conciliateur est de 60 jours apr\u00e8s sa nomination. Le conciliateur d\u00e9posera un rapport sur les discussions aupr\u00e8s de la ministre. Le conciliateur a l\u2019autorit\u00e9 de mettre fin \u00e0 la conciliation plus t\u00f4t s\u2019il estime que les deux camps sont \u00e0 l\u2019impasse. En revanche, la p\u00e9riode de 60 jours peut \u00eatre prolong\u00e9e si la PC et la Guilde sont d\u2019accord et qu\u2019une entente est imminente.<\/p>\n<p>S\u2019il n\u2019y a toujours pas d\u2019entente \u00e0 la fin de la p\u00e9riode de conciliation, il y a une p\u00e9riode de 21 jours pendant laquelle les deux camps peuvent continuer \u00e0 se rencontrer pour tenter de s\u2019entendre. Apr\u00e8s cela, l\u2019un ou l\u2019autre camp peut d\u00e9clencher un arr\u00eat de travail\u00a0: l\u2019employeur peut \u00ab\u00a0cadenasser\u00a0\u00bb les employ\u00e9s (soit les mettre en lock-out) ou les employ\u00e9s peuvent faire la gr\u00e8ve. La partie qui d\u00e9cide d\u2019agir doit donner un pr\u00e9avis de 72 heures.<\/p>\n<p>Toutes ces dispositions sont \u00e9labor\u00e9es dans le Code canadien du travail.<\/p>\n<p><strong>Est-ce qu\u2019une gr\u00e8ve ou un cadenas sont imminents?<\/strong><\/p>\n<p>Une gr\u00e8ve l\u00e9gale ne peut avoir lieu \u00e0 moins que les employ\u00e9s donnent un mandat de gr\u00e8ve \u00e0 leur comit\u00e9 de n\u00e9gociation. Il faut tenir un vote de gr\u00e8ve dans les 60 jours qui pr\u00e9c\u00e8dent la date de commencement d\u2019une gr\u00e8ve.<\/p>\n<p>Il est important de se rappeler qu\u2019un fort mandat de gr\u00e8ve aide souvent \u00e0 d\u00e9bloquer les discussions, puisqu\u2019il montre \u00e0 la compagnie que les employ\u00e9s tiennent \u00e0 d\u00e9fendre leurs droits, et qu\u2019ils appuient leur comit\u00e9 de n\u00e9gociation.<\/p>\n<p>Voter \u00ab\u00a0oui\u00a0\u00bb ne veut pas dire qu\u2019un arr\u00eat de travail est imminent, in\u00e9vitable ou sera d\u00e9clench\u00e9 de fa\u00e7on imm\u00e9diate. En accordant un mandat de gr\u00e8ve au comit\u00e9 de n\u00e9gociation, vous lui donnez l\u2019autorit\u00e9 de prendre tout initiative qu\u2019elle estime n\u00e9cessaire pour conclure une entente \u2013 y compris un arr\u00eat de travail.<\/p>\n<p><strong>\u00c0 quoi devrai-je m\u2019attendre du c\u00f4t\u00e9 de l\u2019employeur?<\/strong><\/p>\n<p>\u00c9videmment nous n\u2019avons pas de contr\u00f4le sur cet \u00e9l\u00e9ment, mais nous osons esp\u00e9rer que l\u2019employeur utilisera le processus de conciliation pour conclure une nouvelle entente.<\/p>\n<p><strong>Et du c\u00f4t\u00e9 de la Guilde?<\/strong><\/p>\n<p>Nous nous engageons \u00e0 travailler fort pour n\u00e9gocier une entente \u00e9quitable.<\/p>\n<p>Jusqu\u2019\u00e0 maintenant nous n\u2019avons pas r\u00e9v\u00e9l\u00e9 beaucoup de d\u00e9tails au sujet des propositions qui sont sur la table. Au fur et \u00e0 mesure que le processus de conciliation suit son course, nous comptons nous exprimer plus ouvertement en ce qui concerne notre point de vue.
