Dear CMG members at CP,
We have come to a resolution, through the arbitration process, regarding the application of legal work breaks as well as article 12 premiums (night, overnight and weekend premiums also called differentials) when travelling on assignments of more than five days listed in Letter of Understanding (LOU) 9 and 10. You can find these letters at the end of your collective agreement.
The resolution also calls for any member who travelled under Letter of Understanding (LOU) 9, and who has claimed and received in the past premiums while on these specific assignments, to contact the Guild BEFORE June 28, 2023 if they wish to be part of the settlement and continue to receive premiums in future Letter of Understanding (LOU) 9 assignments – this, until the end of the current collective agreement. You will be asked for evidence you may have in your possession to prove the fact you did receive premiums in the past or dates on which / trips for which you received them, even if you no longer possess the evidence (records from the year 2018 until now is the window of time we can obtain records from the employer).
Please email karina@cmg.ca cc julieanne@cmg.ca as we will be collecting names and draft a final list of claimants. We will, as per the settlement requirements, send the list of eligible claimants to the employer no later than JUNE 28, 2023.
Your email needs to include the following information :
- Your Name
- You position
- When you travelled in the past on assignments as defined under LOU 9 (name of trips, years, dates if possible)
IMPORTANT : YOU MUST NOTIFY US BEFORE JUNE 28, 2023 OR YOU WILL NOT BE ABLE TO BE INCLUDED IN THE SETTLEMENT RESOLUTION.
