The Canadian Media Guild is fighting to get back pay for an employee who was refused work for several months on account of his disability. The disability may prove to be caused by his job.
A very senior camera person was deemed able to return to work by his doctor early this year as long as CBC accommodated his disability. CBC outright refused to take him back, claiming that no appropriate work was available. The Corporation also did not meet with the employee or the Guild.
After the Guild filed a grievance on behalf of the employee, CBC relented and finally agreed to comply with the Canadian Human Rights Act and the collective agreement. The employee went back to work.
Now the CBC is refusing to pay the wages the employee missed over the several months he was refused work. The Guild is taking the matter to arbitration.
